These Terms of Service (“Terms”) govern your access to and use of Helen's Foundry, provided by Helen's Foundry, Inc. (“Helen's Foundry,” “we,” “us”). By accessing or using Helen's Foundry (the “Service”), you agree to these Terms. If you are using Helen's Foundry on behalf of an organization, you represent that you are authorized to bind that organization.
Early access
Helen's Foundry is offered in early access. It is provided free of charge, is under active development, and may contain bugs or change significantly. We may add, modify, suspend, or discontinue features — or the Service as a whole — at any time, without liability to you.
Accounts
You must provide accurate information and keep your account credentials secure. You are responsible for all activity under your account and for your team members' use of any workspace you administer. Notify us promptly of any unauthorized use.
Acceptable use
You agree not to:
- Use the Service for any unlawful, infringing, or harmful purpose.
- Upload content you do not have the right to use, or that violates others' rights.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems, or probe or circumvent security or access controls.
- Interfere with or disrupt the Service, or impose an unreasonable load (including via automated scraping outside the documented API/MCP surface).
- Reverse engineer or copy the Service except as permitted by law.
Your content
You retain ownership of the content you create in Helen's Foundry. You grant us a limited, worldwide, non-exclusive license to host, store, process, and display that content solely to operate and improve the Service for you — including processing it through the AI features described in our Privacy Policy. You are responsible for your content and for having the rights to use it.
AI features
Helen's Foundry includes AI-assisted features whose outputs may be incomplete, inaccurate, or unsuitable for your purpose. They are provided to assist, not to replace, your own judgment. You are responsible for reviewing AI output before relying on or acting on it.
Third-party services
The Service integrates with third-party services such as GitHub and AI providers. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.
Intellectual property
The Service, including its software, design, and trademarks, is owned by Helen's Foundry and its licensors and is protected by intellectual-property laws. These Terms grant you no rights in our brand or software except the limited right to use the Service.
Feedback
If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them to improve the Service, without obligation to you.
Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. This is especially true during early access.
Limitation of liability
To the fullest extent permitted by law, Helen's Foundry will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Because the Service is currently provided free of charge, our total liability for any claim relating to the Service will not exceed one hundred US dollars (US$100).
Indemnification
You agree to indemnify and hold harmless Helen's Foundry from claims, losses, and expenses arising out of your content or your misuse of the Service or violation of these Terms.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. On termination, the provisions that by their nature should survive (including ownership, disclaimers, and limitation of liability) will survive.
Changes to these Terms
We may update these Terms as the Service evolves. When we make material changes we will update the “Last updated” date above and, where appropriate, notify you. Continued use after changes take effect constitutes acceptance.
Governing law
These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws rules. The state and federal courts located in New Mexico will have exclusive jurisdiction over disputes arising from these Terms.
